Administrative separation vs. court-martial: Know the difference

Military personnel facing disciplinary action often encounter two processes: administrative separation or court-martial.

What is administrative separation?

Administrative separation is a process used by the military to discharge service members without a formal judicial trial. It usually occurs due to misconduct, poor performance or failure to meet physical or mental standards. 

During an administrative separation hearing, a board reviews your case and decides whether discharge is warranted. The standard of proof is relatively low, typically requiring just a preponderance of evidence.

Administrative separations can lead to different types of discharge. The possible outcomes are honorable discharge, general discharge under honorable conditions or discharge under other than honorable conditions. Each outcome can affect your eligibility for veterans’ benefits and future civilian employment.

What is a court-martial?

A court-martial is a formal judicial proceeding similar to civilian criminal trials. It’s reserved for serious offenses like desertion, assault or theft. Unlike administrative separations, a court-martial can result in severe penalties, including imprisonment, demotion, dishonorable discharge or even forfeiture of pay and allowances.

During a court-martial, strict rules of evidence and higher standards of proof apply. Those accused are presumed innocent until proven guilty beyond a reasonable doubt.

Administrative separation is quicker, less formal and usually less damaging.
