Skilled Legal Representation For Members Of Every Service Branch

Fighting For The Benefits You Deserve After Discharge

Every military member hopes that when your military service ends, your sacrifice and hard work result in you obtaining all the benefits you earned. If the military discharges you under less-than- honorable conditions, you may be unable to obtain those benefits. However, there are ways you can still advocate for them.

I understand how frustrating it must feel to have worked so hard only to face rejection for factors that weren’t entirely in your control. You may have been relying on specific military benefits to begin the next chapter of your life. As the lead attorney at Midwest Military & Veterans Law, PLLC, I am here to advocate for the discharge benefits you need and help you navigate the bureaucratic process of requesting them.

What Benefits Can You Typically Get After A Discharge?

Depending on the role and duties you had in the military, your discharge benefits can include:

  • Veterans Affairs healthcare and compensation
  • Removing the stigma of an adverse discharge and restoring pride in your service
  • Civilian employment opportunities
  • Military pension/retirement plan
  • Home loan assistance
  • Education/tuition assistance (through the GI Bill)

I can make a strong case for why you deserve an upgrade in the benefits you receive so that you can continue with your plans as intended. Your story is unique, and I aim to ensure the key people deciding if you get benefits know and understand why you should.

How Does Seeking a Discharge Upgrade Work?

Each branch of service has a Discharge Review Board that can review the “propriety” and “equity” of your discharge and upgrade entries on your DD Form 214. Typically, the process entails a document-review application and, if a decision is not favorable, a personal appearance before a board panel.

To assist my clients, I:

  • Work to gather all necessary documentation to build a compelling case
  • Assist my clients in drafting personal statements and seeking character references
  • Research and draft compelling, persuasive application materials
  • Incorporate federal court precedent and relevant guidance
  • Thoroughly prepare and represent clients at a personal appearance

If your discharge occurred more than 15 years ago, you may apply to the Board for Correction of Military Records. Further, the BCMRs serve as an additional layer of review if you have exhausted your options at the Discharge Review Board. So, no matter how long ago you were separated or how many times you have tried to upgrade your discharge, you still may have options to finally get the relief you seek.
